By accessing, installing, or using the iMessages App ("MoshiMojis"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the App. We reserve the right to modify these Terms at any time without prior notice. Your continued use of the App constitutes acceptance of any changes to the Terms.
Privacy and User Data
The App does not collect, store, or process any of your messaging information. The contents of your messages will remain private and will not be accessed by the App for any purpose.However, the App does collect anonymized information about the types of MoshiMojis and themes chosen by users. This data is aggregated and cannot be traced back to individual users. We use this information solely to keep track of which MoshiMojis and themes are most used, to improve the App's functionality, develop new features, and provide a better user experience.By using the App, you consent to the collection and use of this anonymized MoshiMojis and theme data in accordance with these Terms.
License and Restrictions
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and non-sublicensable license to download, install, and use the App on your device(s). You may not use the App for any illegal or unauthorized purposes. You agree to comply with all applicable laws and regulations when using the App.
Intellectual Property
All rights, titles, and interests in and to the App, including without limitation any and all copyright, trademark, and other intellectual property rights, are owned by us or our licensors. You may not copy, modify, distribute, sell, or lease any part of the App or its content, nor may you reverse engineer or attempt to extract the source code of the App, unless laws prohibit these restrictions or you have our written permission.
Termination
We reserve the right, in our sole discretion, to terminate your access to the App at any time, for any reason or no reason, without notice or liability. You may also terminate your access to the App by uninstalling it from your device(s). Upon termination, all rights and licenses granted to you under these Terms will immediately cease.
Disclaimer of Warranties and Limitation of Liability
The App is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall we, our licensors, or any of our respective affiliates, employees, officers, directors, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your access to or use of the App.
Governing Law and Jurisdiction
These Terms and any disputes arising out of or related to the App or these Terms shall be governed by the laws of the jurisdiction in which the App developer is located, without regard to conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts in the App developer's jurisdiction for the resolution of any disputes.
